About Sport Arena

Sport Arena is a company of sports competitions. It is used to organize molteplici sport tournaments. The organizers create the event, describe all the details and manage all the phases of the tournament. Athletes register one of their teams for the tournament, they can follow the progress of the tournament through the App and by winning games they acquire points.

Content provided by the User

Users are responsible for their own and third party content that they share on Sport Arena, by uploading, inserting content or in any other way. Users release the Owner from any liability in relation to the illicit dissemination of third party content or the use of the Sport Arena, in ways contrary to the law.

The Data Controller does not moderate any content published by the User or by third parties, but undertakes to intervene in the face of reports from Users or orders given by public authorities in relation to content deemed offensive or illegal.

Rights on contents provided by Users

By sending, publishing or viewing content on or through Sport Arena, the User grants the Owner a license without territorial limits, non-exclusive, free of charge and with the right to sublicense, for use, copy , reproduction, processing, adaptation, modification, publication, transmission, display and distribution of such content with any medium or distribution method currently available or developed later.

Content provided by third parties

Users can use services or content included in Sport Arena provided by third parties, but must first have read the terms and conditions of these third parties and have accepted them. Under no circumstances can the Data Controller be held responsible for the correct functioning or availability, or both, of services provided by third parties.

Registration

In order to use the Service or part of it, Users must register by providing, truthfully and completely, all the data requested in the relevant registration form and accept the privacy policy and these general conditions in full. The User will have the burden of keeping his access credentials.

Relationship between Users and owners of the facilities

Sport Arena is not part of the relationship between Users and owners of the sports facilities, nor of the structures organizing events and tournaments, therefore it is exempt from any responsibility for the availability and conditions of the facilities themselves.

How to organize, carry out and pay the tournament fee

Internet connection

In order to use the service it is essential to have a good internet connection. If you use the service with a mobile connection, choose a workstation well supplied by the internet signal (4G recommended).

Creation of a tournament

An Organizer who creates a tournament is required to pay for the service. The fee, unless discounts or cancellations for previous services, corresponds to € 0.50 for each participant registered in the tournament. The calculation of the amount due will be made on the actual number of participants in the tournament who presented themselves and checked in. Any tournament registrants who did not show up or have withdrawn at the end will not be counted in the cost of the service. Payment can be completed online through the appropriate form. Payment is required after the end of the tournament and can be completed in the appropriate section on the organizer page. Further tournaments cannot be organized until the payment of the previous tournaments has been settled.

Organization of a tournament

A tournament can only be organized by an organizing association that has registered on the Sport Arena by a user who then becomes its owner and administrator. An administrator can appoint other users as an administrator of the organizational association. An administrator can also revoke the appointment of administrator for all other administrators other than the owner of the association. 

Each User can create an organizational association using the appropriate interface of the Application and indicating Name, Description, Tax Code / VAT number, Telephone, Email, Website, Facebook address, Instagram address, Twitter address, WhatsApp number, Telegram number, location or geographical area of action of the activity.

The management of the tournament goes through the following phases:

• Open
• registration Closed registration
• Accepted at the desk
• Preparation of pools
• Pools started
• Brackets preparation
• Brackets started
• Concluded

During the game phases the organizer can start the games, create the game queue of the games in the fields available in the structure, record the result of the matches and advance with the pools and the eliminations

The Service is provided "as is"

The Service is provided by the Owner "as is", without any express or implicit guarantee for its accuracy or availability.

Service interruption

The Owner reserves the right to add, remove features or characteristics or to suspend or completely interrupt the provision of the Service, both temporarily and permanently. In the event of a definitive interruption, the Data Controller will act as possible to allow Users to withdraw their information hosted by the Data Controller.

Resale of the Service

Users are not authorized to reproduce, duplicate, copy, sell, resell or exploit any portion of Sport Arena and its Services without the express permission of the Owner, guaranteed directly or through a specific resale program.

Indemnity

The User undertakes to keep the Owner harmless (as well as any companies controlled by it or its affiliates, its representatives, directors, agents, licensees, partners and employees), from any obligation or liability, including any legal costs incurred for defend oneself in court, that should arise in the face of damage caused to other Users or third parties, in relation to the content uploaded online, to the violation of the terms of the law or the terms of these conditions of service.

Permitted use

Users cannot:

• reverse engineer, decompile, disassemble, modify or create derivative works based on Sport Arena or on any portion of it;
• circumvent the IT systems used by Sport Arena or its licensors to protect content accessible through it;
• copy, store, modify, change, prepare derivative works or alter in any way any of the content provided by Sport Arena;
• use any robot, spider, site search / retrieval application, or any other device, process or automatic means to access, recover, scrap or index any portion of the Sport Arena or its contents;
• rent, license or sublicense Sport Arena;
• defame, offend, harass, engage in threatening practices, threaten or otherwise violate the rights (such as the right to privacy and publicity) of others;
• disseminate or publish illegal, obscene, illegitimate, defamatory or inappropriate content;
• to promote (for example through private messages or on the notice boards of the tournament) any other platform, tournament or commercial service without the explicit consent of the Owner;
• create more than one personal account;
• provide false personal information about Sport Arena or create an account on behalf of another person without authorization;
• organize fake or unverifiable tournaments;
• use the Sport Arena channels (for example through private messages or on tournament boards) to promote products, activities or initiatives not strictly related to Sport Arena matches without the explicit consent of the Owner;
• use Sport Arena in any other improper way that violates these Terms.

If the actions of the user do not respect the terms and conditions of the Sport Arena in form and substance or create economic or legal risks for the company, we reserve the right to discontinue the partial or complete supply of all the Sport Arena services. towards the user himself. We will send you a notification email or notify you the next time you log in to your account.

Privacy Policy

For information on the use of personal data, Users must refer to the Sport Arena privacy policy.

Copyright

All Application marks, figurative or registered, and all other signs, trade names, service marks, word marks, trade names, illustrations, images, logos that appear concerning Sport Arena are and remain the exclusive property of the Owner. or its licensors and are protected by applicable trademark laws and related international treaties.

Age requirements

Users declare to be according to the legislation applicable to them. Minors can use Sport Arena only with the assistance of a parent or guardian. In no case under the age of 16 can use Sport Arena.

Limitation of liability

The Owner, within the limits of the legislation in force, is liable for damages of a contractual and extra-contractual nature to Users or third parties only when they constitute immediate and direct consequence, through willful misconduct or gross negligence, of the Sport Arena activity.

The User expressly exonerates and relieves the Application Holder from any liability, within the limits permitted by applicable legislation, in relation to any damages or claims of any type and kind of its own and / or third parties including direct, indirect, punitive damages, incidental, special, damages deriving from lost profits, lost revenues, loss of data or replacement costs deriving from or in any case connected with this agreement.

Changes to these Terms

The Owner reserves the right to make changes to these Terms at any time, giving notice to the User through its publication in the Sport Arena.

The User who continues to use Sport Arena after the publication of the changes accepts the new Terms without reservation.

Transfer of the contract

The Owner reserves the right to transfer, assign, dispose by novation or subcontract all or some of the rights or obligations deriving from these Terms, provided that the User's rights provided herein are not affected.

The User cannot assign or transfer in any way his rights or obligations under these Terms without the written authorization of the Owner.

Communications

All communications relating to Sport Arena must be sent using the contact information indicated.

Nullity

If any clause of these Terms is invalid or ineffective, the aforementioned clause will be eliminated and the remaining clauses will not be affected and will remain effective.

Applicable law and competent court

These Terms and all disputes regarding the execution, interpretation and validity of this contract are subject to Italian law.

The parties undertake to devolve any dispute, within the limits of the applicable legislation, to the jurisdiction of the Italian courts, with exclusive jurisdiction identified in the Rome forum, or in the consumer's residence or domicile.

Use of Artificial Intelligence Features

Sport Arena uses Artificial Intelligence technologies (Google Cloud AI) to automate and speed up the management of sports data (e.g., voice commands for entering results).

By using the platform, you agree that data relating to sports activities (names, nicknames, scores) is processed through these third-party providers within secure and protected environments. The data is not sold to third parties for advertising purposes nor used to train public AI models.

If you wish to maintain the maximum level of anonymity from your playmates and the voice features, we invite you to use a Nickname instead of your real name in your profile settings.

Map Data Management (Caching)

In order to ensure the proper functioning of the application and optimize performance, Sport Arena may temporarily store in the device's local memory (caching) some data provided by third-party services such as Google Maps Platform. This data is stored exclusively for the time strictly necessary (maximum 30 days) to improve the user experience and reduce network consumption, in compliance with the providers' terms of service. The User can clear this cache at any time by emptying the application data from their device settings.

Definitions

Service

The service offered by Sport Arena as described in these Terms and within Sport Arena.

User

The natural or legal person who uses the Service.

Organizer

structure for sporting events.

Administrator of the Organizer

User Authorized to manage the event organizing association and to manage the tournaments organized by it.

Terms and Conditions (or Terms)

These general conditions of service, which constitute a legally binding agreement between the User and the Owner.

Player

User Who signs up for a tournament under these Terms.
